Discharge granted: what is gone and what stays

The order discharges the remaining debts, but not all of them. The credit bureau entry also lives on its own timetable, not the court’s.

WHAT TO DO

Discharge of residual debt is the goal of the whole procedure, but it does not wipe everything. The law expressly excludes some claims, and the credit bureau entry follows a timetable of its own. This step is about knowing the difference and not planning on a mistaken expectation.

Payment discipline is easier to rebuild on an account with no monthly fee: while the bureau entry is alive some banks will refuse, but your right to a basic account (Basiskonto) does not depend on the past procedure.

Max recommends:

The order arrived but the credit bureau entry lingered far longer — and it, not the court, was what blocked finding a flat. Plan for that tail.

Lea recommends:

A month after the order, request your disclosure and check every line. Incorrect entries do occur, and they are only corrected on your application.

FREQUENTLY ASKED QUESTIONS

Which debts are not discharged?

The law expressly excludes claims from intentional wrongful acts, from intentionally breached maintenance duties, and fines and comparable sanctions. These survive the order and may still be enforced.

What happens to the credit bureau entries?

The entry about the proceedings remains for a period after they close and is deleted under the bureau’s own rules rather than by the court order. Ask the bureau directly for the exact duration and verify the deletion actually happened.

Can I open an account and borrow again?

A basic account is a right and does not depend on the past procedure. Credit is harder: while the entry stands, terms are worse and some banks decline. This recovers with time and a clean payment history.

When can I go through it again?

A further discharge is only possible once the statutory blocking period has elapsed. Treat the first procedure as your only attempt for the foreseeable future.
