↰ Werkstudent: working while studying
STEP

Werkstudent is a status of its own, not just a side job

A student working alongside their degree is exempt from health, care and unemployment insurance contributions. Pension contributions stay — the exemption does not cover them.

WHAT TO DO

Working while studying in Germany follows its own rules. The law grants students an exception from compulsory social insurance — provided the degree remains the main activity. That exception is known as the Werkstudentenprivileg. It changes take-home pay noticeably, but it does not apply automatically: it has conditions, and they are assessed by the health insurer rather than the employer.

The first thing to grasp: Werkstudent is not a job title but an insurance status. An employer can put the word in the advert, yet the privilege is assessed by the health insurer — and it looks at the facts, not at the heading on the contract.

For six months I assumed the word Werkstudent in my contract settled everything. Then pension contributions appeared on my payslip and I took it for a payroll error. That is exactly how it should be: the exemption does not cover pension insurance.

FREQUENTLY ASKED QUESTIONS

How does a Werkstudent differ from a Minijob? ▾

A Minijob caps the money, a Werkstudent caps the time. A Minijob limits monthly earnings and allows any number of hours below that ceiling. The working student position is the reverse: pay may be full and carries pension contributions, but hours during lecture periods are limited.

Which contributions exactly fall away? ▾

The law exempts you from statutory health, long-term care and unemployment insurance. Pension insurance remains: contributions are deducted from your salary and credited to your own account at Deutsche Rentenversicherung. The exemption is therefore partial, and your payslip shows it.

Who counts as an ordinary student? ▾

Someone for whom studying genuinely remains the main activity: valid enrolment, attendance, progress through the programme. Mere registration combined with de facto full-time employment does not qualify, and the privilege then falls away.

Does the status apply during a leave semester? ▾

Usually not: during a Urlaubssemester you normally do not count as an ordinary student because the degree is paused. Insurers apply this strictly and the outcome depends on the reason for the leave, so clarify your status with your health insurer beforehand rather than afterwards.
