ROUTE

A lawyer when money is short: advice aid and legal aid

A local-court certificate brings advice for fifteen euros, and the fee can be waived. In proceedings the second mechanism applies, with instalments and a four-year tail.

Legal help costs money, and that cuts off precisely the people who need it most. For such cases the law provides two distinct mechanisms. The first works before court: it pays for advice and, where necessary, correspondence with the other side. The second concerns the proceedings themselves and is judged by a different test β€” whether the case has sufficient prospect of success.

  1. 1

    STEP

Two separate instruments: help before court and help in court

Beratungshilfe pays for advice and correspondence outside court; Prozesskostenhilfe covers the proceedings themselves. The conditions and the offices differ, and confusing them costs time.

  2. 2

    STEP

The application to the local court and the entitlement certificate

The application goes to the local court where you live. If the court does not settle the matter itself, it issues a certificate for a legal adviser of your choice.

  3. 3

    STEP

What the certificate covers and what you pay yourself

Once granted, the firm bills the state treasury. From you it may charge only the advice fee β€” fifteen euros, and that can be waived.

  4. 4

    STEP

Help within proceedings: the application and instalments

In court a different test applies: sufficient prospect of success and no abuse. Income and assets are taken into account, and many applicants pay monthly instalments.

  5. 5

    STEP

What happens afterwards: review and the duty to report

The decision on instalments can be changed where circumstances alter substantially. The duty to report an improvement rests with you and runs for four years.

β€Ί More about this route

The order in the first case is counterintuitive: the route leads not to a law firm but to the local court where you live. The court checks the conditions and issues a certificate naming the matter precisely; where to take it is then your own choice. Once granted, the firm bills the state treasury and may charge you only the advice fee of fifteen euros, which can itself be waived.

This five-step route works through both mechanisms: how they differ and who qualifies, how the application works and the certificate is issued, what is covered and what you pay yourself, how aid within proceedings works with its instalments, and what follows afterwards β€” including the duty to report improvements for four years.

WHERE PEOPLE MOST OFTEN LOSE MONEY AND TIME

FREQUENTLY ASKED QUESTIONS ABOUT THIS ROUTE

Where do I start if there is no money for a lawyer at all?β–Ύ

At the local court where you live, rather than by ringing round law firms. The court decides on the help and issues the certificate you then take to an adviser of your choice.

How long does getting the certificate take?β–Ύ

With complete paperwork the matter is often settled the same day. It drags where proof of income is missing or the matter itself cannot be described clearly.

Does this apply to people without German citizenship?β–Ύ

The statute does not turn on citizenship, but one limit matters: there is no help where the law of another state applies and the facts have no connection to Germany.

What if my federal state does not run this procedure?β–Ύ

In Bremen and Hamburg public legal advice takes its place, and in Berlin people may choose between the two. There the route leads to the local public legal advice service.
