A sanction cut my payment — is that legal? ▾
The limits are tight: a reduction is 30 percent of the standard requirement and, even for repeated breaches, is capped at 30 percent in total; housing and heating costs may not be cut (§ 31a Absatz 1 und 4 SGB II). No reduction applies where it would mean exceptional hardship. Have every sanction checked via objection — it costs nothing.
The Jobcenter sends me to pointless courses — must I go? ▾
Reasonable offers yes; against clearly pointless ones a written justification works: your qualification, search plan, a counter-proposal. Document the dialogue — it carries a later objection.
My rent is above the reasonable level — forced move? ▾
Not immediately: the first year is a grace period (§ 22 Absatz 1 Satz 2 SGB II) — the actual rent is recognised, but at most one and a half times the abstractly appropriate amount. The cost-reduction procedure follows; a required move comes only after a written procedure, and in tight markets the local limits are often contestable.
Must I accept any job? ▾
Reasonableness is broader than under ALG I but has limits: health, immoral conditions and raising a child. For a child the threshold is 14 months of age — from then on raising the child is generally not considered at risk if childcare is secured (§ 10 Absatz 1 Nummer 3 SGB II). A refusal without good reason cuts 30 percent of the standard requirement (§ 31a Absatz 1 SGB II).
