Refusal and objection: the month that decides everything

A refusal is a normal part of the procedure, not the end. But the objection carries a hard deadline, and missing it means starting from scratch.

WHAT TO DO

DOCUMENTS 3

A refusal on the first application is common and does not settle the question. What decides matters is not the content of the refusal but what happens in the following month: an objection filed on time, or not. This is the one point on the route where hesitation is irreversible.

Max recommends:

I received the refusal and considered the matter closed. Six months later I applied again and everything ran from the beginning. An objection in that month would have been one page and saved half a year.

Lea recommends:

Send the objection so that proof of dispatch remains, and put the file reference from the decision in the first line. Half of the long-running stories begin with a letter that could not be matched to a file.

FREQUENTLY ASKED QUESTIONS

Does a refusal mean rehabilitation is not available to me? ▾

Not necessarily. Common grounds are formal or fixable: thin medical reasoning, unclear contribution periods, or the body assuming outpatient treatment suffices. The objection exists precisely to take those points apart one by one.

What do I write when the deadline is running and documents are missing? ▾

The objection can be short and on time, stating that reasoning will follow. What matters is the deadline, because letting it lapse closes the route; the length of the first letter is irrelevant.

Why request access to the file? ▾

A refusal usually rests on an internal medical assessment. Until you have read it you are arguing blind. Once it is in hand, it is clear which conclusion to challenge and with which documents.

What if the objection is rejected too? ▾

Then the route to the social court opens, and the rejection letter states the time limit for filing. Proceedings before the social court are free of court fees for insured persons at first instance, which makes this step less financially risky than an ordinary lawsuit.
