↰ German owners meeting: challenging resolutions and checking the statement
STEP

Take the invitation and agenda apart

The owners meeting is the only place where decisions about the building are made. Errors in the invitation and agenda decide the fate of resolutions long before any vote.

Max recommends:

Request documents in writing and with a date: if the manager stalls, that correspondence later explains to the court why you voted against, or why the vote happened without the necessary figures.

Lea recommends:

Your own motions belong BEFORE the agenda is sent out, not in the meeting itself. An item missing from the invitation will not become a solid resolution, even if everyone agrees.

FREQUENTLY ASKED QUESTIONS

How often must the meeting be held? ▾

The manager convenes the owners meeting at least once a year. In addition they must convene it in the cases set by agreement, and whenever more than a quarter of the owners demand it in text form, stating purpose and grounds.

What if there is no manager, or the manager refuses? ▾

Then the chair of the advisory council, their deputy, or an owner authorised by resolution may convene the meeting. A missing manager does not paralyse the community.

How important is it that an item appears on the agenda? ▾

It is a condition of validity: for a resolution to be valid, the subject must be named when the meeting is convened. Resolutions on unannounced items are the first to be challenged.

May the meeting be held online? ▾

A fully virtual meeting is permitted where the owners resolved on it with at least three quarters of the votes cast, and for a maximum of three years. Separately, they may allow participation and voting by electronic means alongside attendance.

Am I entitled to see documents in advance? ▾

Yes, every owner may demand inspection of the management records from the community. The right does not depend on the goodwill of the manager or on whether the item is on the agenda.
